Parents of Shooting Victim to File Wrongful Death Suit Against Columbia Police

Parents of a Columbia man shot to death in a standoff with Columbia Police and Richland County Sheriff deputies last month have retained a lawyer and are preparing to file a wrongful death lawsuit.

Officers tried to reason with him. In the end, the man armed with a knife, was shot and killed by a deputy. During the standoff, prior to his death, he had set fire to his house twice and was shot and wounded by a Columbia Officer.

His stepfather says he was "shot like a dog," and says both agencies bear responsibility.

The parents and members of the Samson Circle community want answers from Columbia Chief of Police.

The Chief was in charge of the response to his actions. He made the call to bring in the SWAT team, and multiple sources say that decision continues to be heavily criticized in the law enforcement community.

The Chief has been in the hot seat for allowing his son close to the shooting scene. Ultimately helping to jumpstart a review of Columbia Police Operations.

To make matters worse, he was named in a complaint filed in May by one of his own officers. The complaints have been handed to a labor attorney.

Originally posted at InjuryBoard by Chrissie Cole

Family Suing U.S. for Medical Malpractice and Wrongful Death

In November 2004, Patricia, a former sergeant, went to Eisenhower Army Medical Center at Fort Gordon for simple hernia surgery. Only, when the surgeon went in to operate, he punctured her liver.

The doctor's failure to run pre-operative tests caused her to lose half of her body's blood supply, causing her to be in a coma for the next four months.

"It's basically a mistake that should have never been made," said Tabitha, her daughter, who was 15 years old at the time. From there, she watched her mother's health slowly decline.

"She was depressed, and she didn't want to get out, didn't want to go anywhere. "She just wanted to stay at home."

In September 2005, the physical and emotional pain was too much for her bare and she doused herself with gasoline and set herself on fire. Her husband believes that what happened to his wife in Fort Gordon attributed to her taking her own life.

Tuesday, a multimillion dollar lawsuit claiming wrongful death and medical malpractice was filed. Attorneys are waiting on a response from the U.S. government.

Originally posted at InjuryBoard by Christina Cole
